What makes UNISON’s lawyers so different?

Some UNISON members in Wales for example, have already found to their detriment, the real cost of taking their claims through claims farmers. They have ended up paying back most of their compensation to the claims company because they had to sign up to credit agreements that funded the fees payable to doctors and the court on their case. They could have kept every single penny of their compensation by getting their legal advice and representation through UNISON.

Many UNISON members are paying every year for legal expenses insurance through their motor, household and contents insurance policies when they don’t need to. UNISON membership provides legal expenses cover for members and family if they are injured and need to make personal injury claims.

New financial services regulations require all insurance companies who sell insurance, to ask their prospective client what insurance cover they already have so that duplicate policies are not sold to people who don’t need them. So when you ring for an insurance quote, you should be asked whether you are a member of a Trades Union and if you don’t get asked, tell the insurer yourself. You can save yourself money in the process.

What legal services are available?

UNISON membership means that if you have an accident at work or you suffer an industrial disease, then Thompsons will represent and advise you free of charge.

If you or any member of your family are hurt in a road traffic accident, on holiday or in the street, again, your UNISON membership entitles you and your family to free representation and advice.

There are time limits for taking court proceedings for compensation for injury or disease. The time limit is three years from the date of the injury or, if you have developed an industrial disease, the date that you first became aware of your condition. The longer you leave it to seek advice about your injury or condition, the more difficult it is to build up a strong case for you.

If your injury happens when you are abroad, or on the way to your holiday destination either at the airport, or when you’re already on a plane or ship, then there are different (and shorter) time limits for starting court proceedings. So the message is, don’t delay in getting advice.

How does my case get dealt with?

Thompsons’ lawyers will investigate your case and advise you about its strengths (and any weaknesses) as quickly as possible. We work to agreed standards of service required by UNISON and we are audited and judged against those standards.

We use plain English and try to avoid legal jargon wherever we can.

Advice and Representation at the Police Station and Courts

If you need advice and representation at the Police Station, or in the Magistrates or Crown Court on matters relating to your work, then UNISON will arrange for Thompsons to help you.

Thompsons provide a 24 hours a day, 7 days a week service for Police Station advice and representation and have successfully represented many UNISON members in a wide range of cases over many years.

If you need help during the day, you can telephone UNISON Direct. You will need to complete a CR form too, which you can obtain from your branch office. You will be referred straight away to a specialist lawyer for advice.

If you need emergency help out of hours then call the dedicated emergency helpline number 0800 587 7530 . Emergency advice and representation will be immediately arranged for you.

You might be asked to attend an interview with the Health & Safety Executive, or the NHS Counter Fraud Team, or give evidence at an inquest. Again, as a UNISON member, you can access free legal advice and representation for help in these situations from Thompsons’ specialist criminal law team.

Free Initial Advice on Other Matters

UNISON membership means that you can obtain 30 minutes of free initial advice from Thompsons on any other matter, such as consumer issues, debt, neighbour disputes and family difficulties.

Employment Rights

UNISON has an extensive network of very experienced full time officials who will help you and your branch officials with employment rights problems.

Where UNISON consider that your case requires legal input, they will instruct Thompsons to advise and, where appropriate, represent you.

Thompsons’ Employment Rights Unit is renowned throughout the UK for its leading work on behalf of Trades Union members and has fought cases at local Tribunals right through to the European Court to protect existing workers’ rights and to secure additional rights for workers in every area of employment law.

Clinical Negligence

If you are unfortunate enough to be the victim of clinical negligence then you will need specialist advice. This is a very complex area of law and the costs of pursuing cases often significant and so the Legal Services Commission, which provides some public funding for clinical negligence cases, will only allow solicitors who are accredited as specialists by the Law Society to take on cases that they fund.

UNISON provides some assistance to members who need advice about a issues of possible clinical negligence. Thompsons have specialist clinical negligence solicitors on the Law Society Clinical Negligence Panel able to give you specialist advice.
